Teen truck driver cleared in Gasparilla Road fatality

Police have cleared a North Port teen in a fatal accident that resulted in the death of an 81-year-old Canadian shooting photos on Gasparilla Road.

Eberhard Maczynski of Ontario, Canada was struck by a pickup truck traveling the posted 45-mph speed limit and killed at 5:05 p.m. Jan. 30 at 801 Gasparilla Road.

The Lee County Sheriff's Office reported Maczynski parked his vehicle on the west side of Gasparilla Road and was crossing the road to take photos of flowers when he stepped into the path of a northbound pickup truck driven by 19-year-old Terry Ogle of North Port.

Maczinski was en route to the Trauma Center at Lee Memorial Hospital via Med Flight when he died. Police ruled he was at fault in the accident and Ogle has been cleared.

The pedestrian was "found at fault for the crash for violation of right of way," police ruled.
